Draft — pending UK legal review. This document is an engineering baseline for product flows and acceptance recording. Have UK counsel review before relying on it in a dispute.
These Terms of Use (“Terms”) govern your use of Kiwow, a household work-order web app operated at app.kiwow.net (and related UAT hosts). Contact: [email protected].
The legal entity and data controller identity will be published before or with counsel sign-off. Until then, treat the operator as the publisher of Kiwow at the contact above. Privacy processing is described separately in our Privacy notice.
You must be at least 18 years old and able to form a binding contract under the laws of England and Wales. Kiwow is not intended for child profiles or child-directed use.
When you create or join a space, you must tick a box confirming you agree to the current published version of these Terms. We record the version, time, and that the acceptance came from registration or an in-app re-accept screen. Continued use after a version change may require accepting the new version before you can use the app again.
Ticking the Terms box forms a consumer contract. It does not replace separate cookie / storage and marketing choices, which remain optional and granular under our Privacy and Cookie notices.
Kiwow helps households plan and record maintenance tasks, inventory (“My Things”), property records, messages, and related household workflows for homes, boats, cars, and motorbikes.
Kiwow is not a surveyor, solicitor, conveyancer, mechanic, insurer, MOT tester, or professional advisory service. Information you enter or that optional AI features suggest (for example product identify or serial scan) is for your review only and may be wrong or incomplete. You remain responsible for decisions you make about your property.
You control the content you enter (tasks, inventory, records, notes, photos, and similar). When you invite someone, enable pre-sale preview, or transfer a space, you — not Kiwow — are responsible for having the right to share that content (including personal data about household members or third parties) and for the lawfulness and appropriateness of what the recipient sees. Kiwow provides tools to invite, preview, and transfer; it does not review or approve your content.
You must not misuse the service, including by: uploading unlawful or harmful content; attempting to break security or other users’ access; scraping or overloading the service; using the app for spam or fraud; or reverse engineering except where mandatory law allows.
Optional features may send content you choose (for example a photo) to a third-party AI provider solely to generate suggestions for you to accept or dismiss. The in-app screen names the provider before anything is sent. Those providers process data under their own terms. Hosting and infrastructure (including Cloudflare) are described in the Privacy notice.
We aim to keep Kiwow available but do not guarantee uninterrupted access. We may improve, change, or discontinue features with reasonable notice where practical. These Terms do not exclude rights you have under the Consumer Rights Act 2015 or other non-excludable UK consumer law.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.
Subject to that, and to the extent permitted for a free consumer service: Kiwow is provided “as is”; we are not liable for indirect or consequential loss, lost profits, or loss of data that is not our fault; and our total liability for claims arising out of these Terms or the service is limited to £50 or the amount you paid us for the service in the 12 months before the claim (whichever is higher). If you use a free account and paid us nothing, the £50 cap applies unless mandatory law requires otherwise.
You may delete your account from Privacy settings (subject to existing rules, such as transferring mastership if you are the sole master with other members). Retention, export, and privacy rights are described in the Privacy notice.
When we publish a new Terms version, we will require in-app acceptance of that version before continued use. Previous versioned HTML pages remain available so you can see the text you accepted.
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, without limiting any mandatory consumer protections that apply where you live in the UK.
